Government postpones the implementation of REACH and CLP technical regulations

  The European Business Association welcomes the Government’s decision to postpone the implementation of the Technical Regulation on the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH) and the Technical Regulation on the Classification, Labelling and Packaging of Chemical Products (CLP). The relevant Resolution No. 1598, “On Amendments to the Resolutions of the Cabinet of Ministers of Ukraine No. 539 of 10 May 2024 and No. 847 of 23 July 2024”, was adopted by the Cabinet of Ministers of Ukraine on 5 December. This important regulatory act introduces a number of changes that provide businesses with additional time to transition to the new standards, namely: The possibility of circulating, for one more year, chemical products that were already on the market before the CLP regulation entered into force; Postponement of the CLP regulation requirements until 15 November 2027 for chemical substances, and until 1 May 2028 for mixtures; Extension of the deadlines for the pre-registration of substances and subsequent registration stages in accordance with the requirements of the REACH regulation. The EBA Subcommittee on Chemical Safety has consistently and actively advocated for these changes in its positions and publications, and submitted relevant proposals to the Ministry of Economy, Environment and Agriculture of Ukraine. The adoption of Resolution No. 1598 is an important step towards harmonising Ukrainian legislation with European standards, ensuring an effective and gradual adaptation of businesses to the new requirements, as well as creating the necessary infrastructure for their implementation. The EBA will continue to work with government institutions to further improve legislation in the field of chemical safety and to introduce effective regulation of this sector of the economy.
