On 24 June 2025, the State Environmental Inspectorate of Ukraine published for public discussion a draft resolution of the Cabinet of Ministers of Ukraine titled \u201cOn Amendments to the Resolution of the Cabinet of Ministers of Ukraine No. 303 dated 13 March 2022.\u201d The draft proposes reinstating scheduled and unscheduled state supervision (control) measures in the field of environmental protection in territories where active hostilities are not taking place.<\/p>\n
Business representatives note that the draft resolution does not provide convincing evidence that the moratorium on inspections has had a negative impact on compliance with environmental legislation. Furthermore, it does not take into account the existing provisions that allow for unscheduled inspections during martial law, nor does it reflect the key principles of a risk-based approach.<\/p>\n
In the context of full-scale war, economic instability, and significant logistical, energy, and staffing challenges, additional regulatory pressure could significantly hinder the operations of businesses, including those providing critical infrastructure.<\/p>\n
The EBA supports the need for proper oversight of environmental legislation compliance. However, it stresses the importance of maintaining a balance between environmental objectives and the operational realities businesses face during wartime. Given the above, the EBA does not support the adoption of the draft resolution.<\/p>\n
The EBA has communicated this position to the Ministry of Economy, Environment and Agriculture of Ukraine, the State Environmental Inspectorate of Ukraine, and the State Regulatory Service of Ukraine.<\/p>\n","protected":false},"excerpt":{"rendered":"
