The qualitative reboot of the Economic Security Bureau (ESB) is extremely important for the business community, and it is one of the reforms within the framework of Ukraine’s commitments to international partners. However, the current format of the ESB does not correspond to its original concept, and business requires significant qualitative changes in the work of the agency. The business community is interested in reducing the shadow economy rather than increasing pressure on transparent big business.<\/p>\n

Since its inception, the ESB has failed to implement an analytical approach to investigating economic crimes, conduct transparent competitive selection for positions, ensure a stable team and responsible persons, and concentrate its interaction with business, as other law enforcement agencies continued to put pressure on business and conduct investigations under the ESB’s jurisdiction.<\/p>\n

Therefore, in order to carry out an effective reform, the draft Law of Ukraine No. 10088<\/strong> on the reboot of the Economic Security Bureau of Ukraine was registered in the Verkhovna Rada. On October 10, EBA members had the opportunity to discuss this draft law and the reform concept it proposes at a meeting with Yaroslav Zhelezniak<\/strong>, Deputy Chairman of the Verkhovna Rada Committee on Finance, Taxation, and Customs Policy.<\/p>\n

Yaroslav Zheleznyak presented a draft law that proposes a number of measures to restart the work of the ESB, including early termination of the powers of the acting Director and Deputy Directors of the ESB and the announcement of a competition for the top position by the CMU; transparent competition with the majority of representatives from international organizations in the commission and their decisive vote; re-certification of employees within a year after the appointment of a new Director; political independence of the ESB Director; improvement of the competition procedure for ESB employees.<\/p>\n

The European Business Association conceptually supports these changes, including transparent, fair and impartial competition for the position of a new head and renewal of the ESB staff with full re-certification. After all, the effectiveness of the body’s work significantly depends on its head. It is also important to avoid duplication of functions of different law enforcement agencies in investigating economic crimes in order to stop the multifaceted pressure on business that companies still complain about. Interaction with business should be conducted in a clear and civilized manner.<\/p>\n
