{"id":787891,"date":"2021-01-22T14:40:00","date_gmt":"2021-01-22T12:40:00","guid":{"rendered":""},"modified":"2021-01-25T13:33:06","modified_gmt":"2021-01-25T11:33:06","slug":"poryadok-vedennya-reyestru-morskyh-portiv-ukrayiny-potrebuye-doopratsyuvannya","status":"publish","type":"post","link":"https:\/\/new.eba.com.ua\/en\/poryadok-vedennya-reyestru-morskyh-portiv-ukrayiny-potrebuye-doopratsyuvannya\/","title":{"rendered":"The procedure for maintaining the Register of Seaports of Ukraine needs to be revised"},"content":{"rendered":"<p><span data-preserver-spaces=\"true\">The European Business Association addressed the Ministry of Infrastructure of Ukraine with proposals to revise the draft Resolution of the Cabinet of Ministers &#8220;On Amendments to the Procedure for Maintaining the Register of Seaports of Ukraine&#8221;, which was published on the Ministry&#8217;s website on December 29.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">According to the EBA experts, the current version of the Procedure obliges port operators to provide excessive information to the administrator of the Register of Seaports &#8211; the Administration of Ukrainian Sea Ports Authority, namely:<\/span><\/p>\n<ul>\n<li><span data-preserver-spaces=\"true\">Information that can be obtained from other open state registers;<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">Copies of agreements to which USPA is a party;<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">Information concerning confidential port-security materials or unauthorized access to them;<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">Permits or agreements not related to the information to be published in the Register;<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">Information that may contain a trade secret.<\/span><\/li>\n<\/ul>\n<p><span data-preserver-spaces=\"true\">The EBA experts also consider it appropriate to provide in the draft resolution the possibility and procedure for making changes to the Register, as well as the mechanism for appealing the actions or inaction of the Administrator to avoid potential abuse or erroneous exclusion of information from the Register.<\/span><\/p>\n\t<div class=\"blockquote-custom-big animate-block animate-block--before animate-block--to-right\">\n\n\t\t<div class=\"quote-header\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t<img decoding=\"async\" src=\"https:\/\/new.eba.com.ua\/wp-content\/uploads\/2017\/10\/Daria-Sichkar.png\">\n\n\t\t\t\t\t\t\t<span class=\"name\">Daria Sichkar<\/span>\n\t\t\t\n\t\t\t\t\t\t\t<span class=\"position\">EBA Logistics Committee Manager<\/span>\n\t\t\t\t\t<\/div>\n\n\t\t\t\t\t<blockquote class=\"blockquote-custom\">\n\t\t\t\tBusiness is convinced that the requirements of this Resolution regarding information provision can and should be optimized. Companies should not spend time preparing and providing data that is publicly available or already known to USPA. The same applies to irrelevant or confidential documents that do not contain useful information for the Registry Administrator. Such initiatives not only create unnecessary headaches for business but also run counter to the deregulation policy declared by the Ministry of Infrastructure and USPA. \n\t\t\t<\/blockquote>\n\t\t\t\t\n\t<\/div>\n\n<p><span data-preserver-spaces=\"true\">Therefore, the European Business Association has prepared a formal appeal to the Ministry of Infrastructure with a request to revise the text of the draft Resolution and remove the above provisions. Adoption of the document in the current version may create additional pressure on businesses and put the community in excessive dependence on the actions of USPA.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">It will be recalled that an identical document was already published on the website of the Ministry of Infrastructure in November. At that time, the Association also provided its comments on the text of the Resolution, which, however, were never taken into account.
