However, the situation remains unresolved \u2014 no draft decision has yet been communicated to market participants. As a result, the state of uncertainty unfortunately continues, and the lack of clarity continues to influence pharmaceutical companies\u2019 policies concerning their activities in the Ukrainian market.<\/strong><\/p>\n<p data-start=\"765\" data-end=\"1190\">Pharmaceutical manufacturers note that this situation limits effective planning and creates uncertainty regarding the continuation of the companies\u2019 planned activities in Ukraine \u2014 from supplying certain volumes of reimbursed medicines in future periods or outside the reimbursement mechanism, to implementing projects aimed at bringing additional value to the Ukrainian healthcare system with the support of manufacturers.<\/p>\n<p data-start=\"1192\" data-end=\"1716\">As member companies of the European Business Association have previously emphasized in their communications to the Ministry of Health and other public authorities, <strong>the reimbursement programme is currently the only stable mechanism of state-funded compensation for medicinal products<\/strong>, designed to ensure continuous patient access to treatment <strong>without time restrictions<\/strong>. The importance of the programme, <strong>which from the outset has been based on voluntary partnership between manufacturers and the state<\/strong>, cannot be overstated.<\/p>\n<p>Participation in the reimbursement programme is voluntary; therefore, stability and predictability of its participation rules are of key importance for businesses, as well as the ability to plan their market activities taking into account the presence or absence of barriers. The outcomes of manufacturers\u2019 participation, both within and outside the programme, in the short and medium term directly depend on this. Planning by manufacturers, both current and potential participants of the programme, concerns those INNs already included in it, those INNs declared by state authorities for future inclusion, as well as INNs for which public financing is currently objectively not planned. Unfortunately, the business community cannot interpret the uncertainty and breaches of programme rules, revealed in September 2025, as factors that would positively influence planning of future operations in the Ukrainian market.<\/p>\n<p>The EBA\u2019s Healthcare Committee, which unites leading Ukrainian and international pharmaceutical manufacturers, consistently advocates for transparency and clear, predictable operating rules. Today, it is particularly important to manage the healthcare and pharmaceutical sectors, as an integral part of it, with a macro-level understanding of the conditions under which business operates in Ukraine. A proactive approach from public authorities in anticipating potential risks and timely preventing negative consequences will help strengthen the state\u2013business partnership and enable effective joint steps to address healthcare needs.<\/p>\n<p>Despite current challenges, businesses continue to fulfil their commitments: they ensure regular supplies and stock of medicines for Ukrainian patients, implement social projects and renew plans for their continuation, launch new high-tech initiatives for implementation in Ukraine, support and develop patient support programmes, invest in clinical research, and contribute to the further development of health technology assessment systems.<\/p>\n<p>To avoid further uncertainty and undesirable consequences, the EBA calls on the Ministry of Health <strong>to ensure the uninterrupted update of the National Price Catalogue, given the approaching deadlines for its next revision under current legislation, by resolving the legal conflict within this year, and to publish the decision on synchronizing the Reimbursement List and the National Catalogue as soon as possible<\/strong>. This would help mitigate the risks of manufacturers revising their business plans for this and other areas of activity in the near future, as well as reduce these risks in the longer term.<\/p>\n<p>Recognizing the complex wartime context, the Association emphasizes that <strong>maintaining continuity and predictability of manufacturers\u2019 participation in the reimbursement programme, whose functioning has proven adherence to principles of operational sustainability, transparency, and fair competition, is essential for the development of Ukraine\u2019s pharmaceutical sector and for sustaining the trust of pharmaceutical companies<\/strong>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>More than two months have passed since the issue of a legal conflict regarding the functioning of the National Price Catalogue and the List of Medicinal Products Eligible for Reimbursement was discussed between the Ministry of Health of Ukraine and representatives of the pharmaceutical business community.
