{"id":786476,"date":"2025-09-19T22:21:18","date_gmt":"2025-09-19T19:21:18","guid":{"rendered":""},"modified":"2025-10-02T22:24:59","modified_gmt":"2025-10-02T19:24:59","slug":"ukraine-restores-statutes-of-limitation-suspended-during-martial-law","status":"publish","type":"post","link":"https:\/\/new.eba.com.ua\/en\/ukraine-restores-statutes-of-limitation-suspended-during-martial-law\/","title":{"rendered":"Ukraine restores statutes of limitation suspended during martial law"},"content":{"rendered":"<p style=\"font-weight: 400;\">On 14 May 2025, the Ukrainian parliament passed the law #4434-IX \u201c<em>On amendments to Final and Transitional Provisions of the Civil Code of Ukraine regarding the renewal of the limitation period<\/em>\u201d (<a href=\"https:\/\/zakon.rada.gov.ua\/laws\/show\/4434-IX%23Text\" target=\"_blank\" rel=\"noopener\">https:\/\/zakon.rada.gov.ua\/laws\/show\/4434-IX#Text<\/a>), which restores the Ukrainian Civil Code\u2019s limitation period for filing claims to the courts.<\/p>\n<p style=\"font-weight: 400;\">Generally, the limitation period for filing a court claim is three years from when a person became aware or should have become aware of the rights\u2019 infringement. Failure to comply with the limitation period can result in the court rejecting the claim on merits.<\/p>\n<p style=\"font-weight: 400;\">Due to pandemic, and then at the beginning of russia\u2019s war of aggression against Ukraine, the Civil Code of Ukraine was supplemented, suspending limitation periods for the duration of martial law.<\/p>\n<p style=\"font-weight: 400;\">The new law now restores the general regulation for limitation periods under the Civil Code.
