{"id":784420,"date":"2024-09-27T15:58:07","date_gmt":"2024-09-27T12:58:07","guid":{"rendered":""},"modified":"2024-09-27T16:07:40","modified_gmt":"2024-09-27T13:07:40","slug":"novi-pidstavy-dlya-zvilnennya-ta-vymogy-do-pravyl-vnutrishnogo-trudovogo-rozporyadku","status":"publish","type":"post","link":"https:\/\/new.eba.com.ua\/en\/novi-pidstavy-dlya-zvilnennya-ta-vymogy-do-pravyl-vnutrishnogo-trudovogo-rozporyadku\/","title":{"rendered":"New termination ground and requirements for internal labor regulations (employee handbook)"},"content":{"rendered":"<p>On 27 September 2024, the Law of Ukraine &#8220;On Amendments to the Labor Code of Ukraine on Establishing Additional Grounds for Termination of Employment Agreements at the Initiative of the Employer and Certain Other Issues&#8221; No. 3768-IX dated 4 June 2024 (&#8220;<strong>Law<\/strong>&#8220;) (with certain exceptions) will come into force. The Law, among other things, details the rules applicable to internal labor regulations (&#8220;<strong>Employee Handbook<\/strong>&#8220;) and establishes new termination grounds.<\/p>\n<p><strong>Key changes<\/strong><\/p>\n<ul>\n<li>The Employee Handbook may include, among other things, rules on (a)\u00a0employees&#8217; nondisclosure obligations and (b)\u00a0the terms of work with confidential information (&#8220;<strong>Information Rules<\/strong>&#8220;).<\/li>\n<li>The Information Rules are obligatory for companies of strategic importance for the economy and security of the state and\/or objects or operators of critical infrastructure.\u00a0<\/li>\n<li>A new termination ground at the employer&#8217;s initiative due to the employee&#8217;s failure to comply with the Information Rules has been introduced.<\/li>\n<\/ul>\n<p><strong>Recommendations\u00a0<\/strong><\/p>\n<p>We recommend that employers in Ukraine take the abovementioned legislative changes into account in their business activities and supplement the Employee Handbook with the Information Rules to protect the company&#8217;s confidential information and to be able to rely on the new termination ground.<\/p>\n<p><strong>Contacts:<\/strong><\/p>\n<div><a href=\"mailto:Lina.Nemchenko@bakermckenzie.com\">Lina Nemchenko<\/a><\/div>\n<div>Partner Baker McKenzie<\/div>\n<div>\u00a0<\/div>\n<div><a href=\"mailto:Mariana.Marchuk@bakermckenzie.com\">Mariana Marchuk<\/a><\/div>\n<div>Counsel Baker McKenzie<\/div>\n<div>\u00a0<\/div>\n<div><a href=\"mailto:Anna.Stepanowa@bakermckenzie.com\">Anna Stepanowa<\/a><\/div>\n<div>Associate Baker McKenzie<\/div>\n","protected":false},"excerpt":{"rendered":"<p>On 27 September 2024, the Law of Ukraine &#8220;On Amendments to the Labor Code of Ukraine on Establishing Additional Grounds for Termination of Employment Agreements at the Initiative of the Employer and Certain Other Issues&#8221; No. 3768-IX dated 4 June 2024 (&#8220;Law&#8220;) (with certain exceptions) will come into force.
