{"id":775655,"date":"2021-07-13T12:18:14","date_gmt":"2021-07-13T09:18:14","guid":{"rendered":""},"modified":"2021-07-13T13:02:29","modified_gmt":"2021-07-13T10:02:29","slug":"advokaty-golaw-vidstoyaly-pozytsiyu-u-skladnomu-kryminalnomu-provadzhenni","status":"publish","type":"post","link":"https:\/\/new.eba.com.ua\/en\/advokaty-golaw-vidstoyaly-pozytsiyu-u-skladnomu-kryminalnomu-provadzhenni\/","title":{"rendered":"GOLAW lawyers defended their position in a complex criminal proceeding"},"content":{"rendered":"<p>GOLAW lawyers defended their position regarding early appeal of the detective on procedural restrictions in the\u00a0High Anti-Corruption Court\u00a0of Ukraine.<\/p>\n<p>The volume, complexity and conditions of access to the materials of criminal proceedings are the circumstances on the basis of which the judge determines whether there is a delay in acquaintance with the materials of criminal proceedings on the part of the defense.<\/p>\n<p>As practice shows, investigators and detectives, being a hurry to submit to the court the completed pre-trial investigation of criminal proceeding, initiate temporary restrictions for the defense in acquaintance with the materials. Consequently, investigators don\u2019t take into account the formula established by the legislator.<\/p>\n<p>Thus, the consequence of such a hasty procedural initiative is the refusal of the court to satisfy the appeal for limitation of the defense rights.<\/p>\n<p>The result of the joint work of GOLAW lawyers was the decision taken by the investigating judge of the court not in favor of the detective.<\/p>\n<p>GOLAW partners, lawyers <strong>Angelika Moiseeva<\/strong> and <strong>Igor Glushko<\/strong> worked on the project.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>GOLAW lawyers defended their position regarding early appeal of the detective on procedural restrictions in the\u00a0High Anti-Corruption Court\u00a0of Ukraine.
