{"id":774911,"date":"2021-01-28T13:38:05","date_gmt":"2021-01-28T11:38:05","guid":{"rendered":""},"modified":"2021-01-28T13:41:14","modified_gmt":"2021-01-28T11:41:14","slug":"ukrayina-zapuskaye-systemu-monitoryngu-vykydiv-parnykovyh-gaziv","status":"publish","type":"post","link":"https:\/\/new.eba.com.ua\/en\/ukrayina-zapuskaye-systemu-monitoryngu-vykydiv-parnykovyh-gaziv\/","title":{"rendered":"Ukraine Launches a Monitoring System of Greenhouse Gas Emissions"},"content":{"rendered":"<p>On 1 January 2021, the Law of Ukraine No. <a href=\"https:\/\/zakon.rada.gov.ua\/laws\/show\/377-20\/print\" rel=\"nofollow noopener\" target=\"_blank\">377-IX<\/a> &#8220;On the Basics of Monitoring, Reporting and Verification of Greenhouse Gas Emissions&#8221; (the &#8220;<strong>Law<\/strong>&#8220;) entered into force.<\/p>\n<p>This Law harmonizes Ukrainian legislation with standards of EU Law (an obligation for Ukraine under the <a href=\"https:\/\/trade.ec.europa.eu\/doclib\/docs\/2016\/november\/tradoc_155103.pdf\" rel=\"nofollow noopener\" target=\"_blank\">EU-Ukraine Association Agreement<\/a>) and implements the provisions of Directives No. <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=celex%3A32003L0087\" rel=\"nofollow noopener\" target=\"_blank\">2003\/87\/\u0415\u0421<\/a> and No.\u00a0<a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=celex%3A32004L0101\" rel=\"nofollow noopener\" target=\"_blank\">2004\/101\/\u0415\u0421<\/a>. It also fulfills requirements under the United Nations Framework Convention on Climate Change and the Paris Agreement.<\/p>\n<p>The Law introduces the following:<\/p>\n<ul>\n<li>The following emissions are subject to monitoring: carbon dioxide (CO2), methane (CH4), nitrous oxide (N2O), hydrofluorocarbons (HFCs), perfluorocarbons (PFCs), sulfur hexafluoride (SF6), and other gaseous constituents in the atmosphere that absorb and emit infrared radiation.<\/li>\n<li>Each installation that produces or may produce greenhouse gas emissions is subject to the monitoring requirement.<\/li>\n<li>The legal entities or private entrepreneurs who operate the installations owned or used must monitor the emissions themselves (the &#8220;<strong>Operators<\/strong>&#8221; under the Law).<\/li>\n<li>Operators are free to choose the monitoring methods but must develop a <strong>monitoring plan<\/strong>. The competent state executive authority (the &#8220;<strong>Authorized Body<\/strong>&#8220;) approves these plans.<\/li>\n<li>A special <a href=\"https:\/\/mepr.gov.ua\/news\/32021.html\" rel=\"nofollow noopener\" target=\"_blank\">Unified Register<\/a> is about to be created to collect information on all emission-producing installations. So-called verifiers and Operators submit all documents to the Authorized Body in hard copies or by physical mail until the Unified Register is officially launched.<\/li>\n<li>Operators submit their monitoring reports to the verifiers on an annual basis. The verifiers are certified contractors freely chosen by the Operator, who issue a certificate of conformity\/non-conformity for each installation.<\/li>\n<\/ul>\n<p>In order to ensure the provisions of Law clear and accurate, the Government of Ukraine is empowered under the Law to adopt:<\/p>\n<ul>\n<li>a list of activities and greenhouse gas emissions that are subject to monitoring, reporting, and verification;<\/li>\n<li>a procedure to monitor and report greenhouse gas emissions; and<\/li>\n<li>a procedure for the verification of Operator&#8217;s reports on greenhouse gas emissions.<\/li>\n<\/ul>\n<p>Therefore, the provisions of the Law should be understood and interpreted within the framework of delegated regulations adopted by the Government.<\/p>\n<p>To implement the above, the Government of Ukraine adopted on 23 September 2020 Resolution No.\u00a0<a href=\"https:\/\/zakon.rada.gov.ua\/laws\/show\/960-2020-%D0%BF\/print\" rel=\"nofollow noopener\" target=\"_blank\">960<\/a>. It details the procedures, calculation methods, and reporting requirements set forth by the Law.<\/p>\n<p>The Law is one of the first necessary steps to improve the legal regulation of monitoring and reporting processes for greenhouse emissions in Ukraine.
