{"id":773046,"date":"2020-04-16T09:00:25","date_gmt":"2020-04-16T06:00:25","guid":{"rendered":""},"modified":"2020-05-02T19:45:11","modified_gmt":"2020-05-02T16:45:11","slug":"ukraine-clarifies-rules-on-rent-reductions-for-tenants-during-quarantine","status":"publish","type":"post","link":"https:\/\/new.eba.com.ua\/en\/ukraine-clarifies-rules-on-rent-reductions-for-tenants-during-quarantine\/","title":{"rendered":"Ukraine clarifies rules on rent reductions for tenants during quarantine"},"content":{"rendered":"<p>On 13 April 2020, the Ukrainian parliament adopted the Law of Ukraine \u201cOn the amendment to the Law of Ukraine \u2018On the State Budget of Ukraine for 2020\u2019 \u201d, which amends the transitory provisions of the Civil Code and clarifies the rules on rent reductions for tenants whose businesses have suffered from the quarantine restrictions imposed by the government in response to\u00a0the COVID-19 pandemic. This State Budget Law went into effect on 18 April 2020.<\/p>\n<p>The Civil Code provides\u00a0that\u00a0tenants may claim a reduction of their rental fees if they are not fully able to use their leased property due to circumstances beyond their control. The State Budget Law clarifies that the quarantine measures enacted by the Decree of the Cabinet of Ministers of Ukraine No. 211, \u201cOn Preventing the Spread of Coronavirus COVID-19 in Ukraine\u201d, entitle the tenants to claim a rent reduction in the following cases:<\/p>\n<ul>\n<li>The quarantine measures restrict a certain type of business; or<\/li>\n<li>The quarantine measures restrict the access of third-party visitors to the leased property.<\/li>\n<\/ul>\n<p>Thus, tenants may claim a reduction of their rental fees if they are not able to fully use their leased property due to quarantine measures. Please note, that the\u00a0State Budget Law does not provide\u00a0for any compensatory measures for landlords granting temporary rent reductions or rent relief to their tenants.
