However, the transparency and specificity of the intentions of the contract parties are important, because the arbitrators&#8217; interpretation of the provisions during the litigation may play against you.<\/p>\n<p>At the second webinar on the topic &#8220;Contracts in English Law&#8221;, of the Transport, Shipping and International trade Web-course, we continued a comprehensive analysis of English Law contracts and focused mostly on the typology of contract terms and conditions. Also, made their comparative characteristics in the context of Ukrainian and English Law. Thus, according to the legislation of Ukraine, there are 2 types of contractual terms: <strong>essential<\/strong> (established by law and constituting the subject of the contract) and <strong>insignificant<\/strong> (ordinary or accidental). And English Law distinguishes <strong>express terms<\/strong> (expressly communicated and set out in the contract) and <strong>implied<\/strong> (not set out expressly, but implied by law, custom or fact).
