{"id":772186,"date":"2019-12-10T11:45:31","date_gmt":"2019-12-10T09:45:31","guid":{"rendered":""},"modified":"2019-12-10T13:18:25","modified_gmt":"2019-12-10T11:18:25","slug":"illyashev-ta-partnery-uspishno-zahystyly-interesy-ukrrichflot","status":"publish","type":"post","link":"https:\/\/new.eba.com.ua\/en\/illyashev-ta-partnery-uspishno-zahystyly-interesy-ukrrichflot\/","title":{"rendered":"Ilyashev &#038; Partners Successfully Defended the Interests of Ukrrichflot"},"content":{"rendered":"<p>The antitrust practice team of Ilyashev &amp; Partners Law Firm under the guidance of Partner <strong><a href=\"http:\/\/attorneys.ua\/en\/lawyers\/fefelov-oleksandr-yurijovich\/\" target=\"_blank\" rel=\"noopener\">Oleksandr Fefelov<\/a> <\/strong>and Counsel <strong><a href=\"http:\/\/attorneys.ua\/en\/lawyers\/gudiy-valeriia\/\" target=\"_blank\" rel=\"noopener\">Valeriia Gudiy<\/a><\/strong> defended the interests of Ukrrichflot Shipping Company in a case on monopoly abuse by JSC Ukrzaliznytsia (Ukrainian Railways).<\/p>\n<p>In order to defend the client\u2019s interests Ilyashev &amp; Partners initiated an appeal to the Antimonopoly Committee of Ukraine (AMCU) and proved the violation of legislation by JSC Ukrzaliznytsia. For the abuse of monopoly position in the market, which resulted in the restriction of interests of shipowners and Ukrrichflot in particular, the AMCU imposed a fine of UAH 760 thousand on JSC Ukrzaliznytsia and obliged JSC Ukrzaliznytsia to remedy the violation by preparing an economically justified estimation of costs associated with the lifting of bearers of the railway bridges No. 1 and No. 5 across the Dnieper River to be reimbursed by the shipowners. Ilyashev &amp; Partners Law Firm represented the interests of Ukrrichflot Shipping Company at all stages of litigation up to the Supreme Court.<\/p>\n<p><em>\u201cWe considered these actions of Ukrzaliznytsia to be illegal from the very beginning, and we are glad that the opinion of the Antimonopoly Committee of Ukraine and of the Supreme Court of Ukraine completely coincided with ours,<\/em> \u2013 commented on the decision <strong>Oleksandr Fefelov<\/strong>, a Partner, Attorney at Law and Head of the Antitrust and Competition Practice at Ilyashev &amp; Partners. \u2013<em> This decision may become a precedent when solving similar cases in other sectors of the economy\u201d.<\/em><\/p>\n<p><em>Ukrrichflot Shipping Company is Ukraine\u2019s largest river carrier. It operates in Dnipropetrovsk, Zaporizhzhia, Mykolaiv and Kherson river ports. The Company\u2019s fleet mainly consists of bulk carriers used for sea and river transportations.
