Vasil Kisil & Partners lawyers have successfully represented Ukrainian enterprise, a member of the Mondel\u0113z International group of companies, in dispute with the Trostianets City Council regarding increasing the rent.<\/p>\n
The Trostianets City Council filed a lawsuit against Mondelez Ukraine seeking to hold as concluded a supplemental agreement to the land lease agreement for increasing the rent. As the grounds for the claim, the City Council has referred to its own decision to increase the rent.<\/p>\n
The local court dismissed the claim in full. The court agreed with the defendant\u2019s arguments that neither the law nor the agreement provided for the lessor\u2019s right to amend, unilaterally and on its own initiative, the agreement, so that to revise the rent, and that the decision of the City Council to increase the rent could not serve as a legislative ground for amending the agreement. The City Council agreed with and did not appeal the court’s decision.<\/p>\n
