Government adopts Resolution No. 1541 on business compensation and war-risk insurance

  The European Business Association welcomes the adoption by the Cabinet of Ministers of Ukraine of Resolution No. 1541 dated 28 November 2025, which introduces a state mechanism for partial compensation of the value of destroyed or damaged business property, as well as partial compensation of insurance premiums under war-risk insurance contracts. This important regulatory act enters into force on the day of publication and will apply from 1 January 2026. For a long time, the EBA Committee on Ukraine’s Recovery has been drawing the attention of public authorities, including the Cabinet of Ministers of Ukraine, the Verkhovna Rada, the Ministry of Economy and others, to the need to establish effective mechanisms for war-risk insurance, as well as the importance of supporting enterprises that have suffered destruction as a result of armed aggression. The adoption of Resolution No. 1541 is effectively the first national mechanism that enables compensation for war-related destruction and damage. At the same time, compensation of insurance premiums stimulates the development of the war-risk insurance market, an instrument particularly vital for businesses during wartime. What the new mechanism provides 1. Partial compensation for destroyed or damaged property The mechanism applies to assets destroyed or damaged as a result of russia’s armed aggression. It provides for: compensation for actual losses of up to UAH 10 million, taking into account compensation already received by the company from state or local budgets, payment of compensation via the Export Credit Agency (ECA), transfer of the state’s right of claim against russia once the payment is made. 2. Partial compensation of insurance premiums under war-risk insurance contracts The mechanism includes: reimbursement of part of the paid insurance premium — up to UAH 1 million, the opportunity for businesses to conclude war-risk insurance contracts with private insurance companies, submission of an application to the ECA after the contract term has ended, a one-off fee of UAH 5,000 to participate in the programme, availability of the mechanism for private companies and individual entrepreneurs. Eligible applicants Businesses that: are private entities or individual entrepreneurs, are not subject to sanctions, have no tax arrears and are not in bankruptcy proceedings, have incurred losses or concluded insurance contracts after the resolution enters into force. The EBA welcomes the adoption of Resolution No. 1541 and considers it an important step in supporting business amid war-related risks. The EBA will continue working with government institutions to further improve compensation mechanisms and create a favourable environment for the recovery of Ukraine’s economy.
