Ilyashev & Partners Successfully Defends Domestic Producer: Court Upheld Anti-Dumping Measures on Steel Wire Imports from China

On 20 June 2025, the Kyiv District Administrative Court dismissed all claims filed by a Ukrainian importer of Chinese products, TPP Gradient-Ukraine LTD, seeking to lift anti-dumping measures imposed on imports to Ukraine of wires from the People’s Republic of China. Ilyashev & Partners Law Firm represented one of the largest Ukrainian producers of welding materials, PlasmaTec LLC, as a third party to this case. The court upheld the Decision No. AD-549/2023/441-01 dated 13 July 2023 issued by the Interdepartmental Commission on International Trade (ICIT) on the imposition of final anti-dumping measures on imports to Ukraine of wires originating from the People’s Republic of China, which established the final anti-dumping duty at 32.6%. Thus, the court found it necessary to protect the violated rights of domestic producers from dumped imports of goods into Ukraine, which caused significant damage to domestic producers, and confirmed the legality of the actions of the Ministry of Economy and the Commission, pointing to compliance with the established procedure, proper assessment of evidence and the validity of the conclusions that formed the basis for the decision to impose duties. The anti-dumping measures remain in force for five years from the date of their imposition. As previously reported, Ilyashev & Partners Law Firm also initiated the anti-dumping investigation into imports to Ukraine of wires originating from China. Ilyashev & Partners’ International Trade Team secured the imposition of duties on Chinese products until 2028. On 21 April 2025, in order to protect a domestic producer, Ilyashev & Partners Law Firm initiated an anti-dumping investigation into the circumvention of anti-dumping duties on wires from China through their imports from Malaysia. Through the efforts of Ilyashev & Partners’ International Trade Team, the ICIT resolved to impose advance payments on Malaysian exporters at the current Chinese duty rate of 32.6%, effective until the conclusion of the investigation.
