Change of conditions for obtaining work permits for foreigners

  On 15 October 2022, Law No. 2623-IX of Ukraine On Amendments to Certain Laws of Ukraine on the Employment of Foreigners and Stateless Persons in Ukraine and the Provision of Mediation Services in Employment Abroad dated 21 September 2022 (Law) came into effect, which simplifies the procedure for issuing and extending work permits for foreigners and stateless persons. Key changes The minimum salary level for foreigners has been reduced to the minimum salary level for Ukrainian citizens. Monitoring of payment of unified social tax by employers in relation to their foreign employees will be effected by way of exchange of information between the State Employment Service and the Pension Fund of Ukraine. Additional categories of documents have been added to the list of documents that can be submitted to support a work permit application. The fee for issuing or extending work permits has been increased. The issuance and extension of work permits for citizens of the Russian Federation, the Republic of Belarus, or other states recognized as posing a threat to the national interests of Ukraine require the approval of the Security Service of Ukraine. We recommend that employers take these legislative changes into account when considering employing foreign citizens in Ukraine.
